NIH Data Management and Sharing Policy

Guide to Complying With the 2023 NIH Data Management and Sharing Policy

Compliance and Enforcement

What does it mean to be compliant?

Being compliant with this policy means submitting a DMS Plan while applying for a grant and following that plan through the award of the grant. The NIH understands that it is likely the plan may need to change, but changes should be addressed during regular reporting intervals.

What are the timelines for compliance?

  • At point of application: DMS Plan should be submitted and costs included in the budget.
  • At point of publication: For data that the DMS Plan says will be shared, data related to a publication will need to be shared as described in the DMS Plan.
  • At end of the award period: For data that the DMS Plan says will be shared, data not yet shared as part of the article publication process will need to be shared as described in the DMS Plan.

What happens if a researcher is non-compliant?

Non-compliance with the policy may be taken into account by the NIH for future funding decisions for the recipient institution.
